§ 1 Scope and Provider
These terms and conditions apply to all orders, the consumer (§ 13 BGB) through the online shop of

A consumer is any natural person who enters into a legal transaction for a purpose that can be attributed neither to their commercial nor to their independent professional activity.

 

§ 2 Conclusion of contract
§ 2.1 The product presentations in the online shop are used to submit a purchase offer. By clicking on the button "Buy" you make a binding purchase offer. The sale of our products is only for private use.

§ 2.2 We can accept your order by sending a separate order confirmation by e-mail or by delivery of the goods within 14 days. Confirmation of the receipt of the order is made by automated e-mail immediately after sending the order and does not constitute acceptance of an agreement.

 

§ 3 Prices
The prices quoted on the product pages include the legal value added tax and other price components for private individuals and exclude costs for shipping, insurance and payment. The prices for our business customers are exclusive of VAT and exclude shipping, insurance and payment.

 

§ 4. Shipping costs
§ 4.1 The shipping costs depend on the shipping method you selected and the specific content of your order.

There are different costs for the shipping methods offered by us in the online shop. These shipping costs depend on the destination country, the selected shipping method and the content of your order. In the shipping cost overview, which you can reach from the product pages and the shopping cart system, you will see the shipping methods offered in our shop with your conditions and costs. Individual products bring their own surcharge on the shipping costs. This surcharge is displayed on the product pages and in the shopping cart system. The total shipping costs will then be clearly communicated in the shopping cart system and on the order page.

Possibly. incurred insurance costs can also be found in the shipping costs overview, the shopping cart system and the order page.

§ 4.2 When paying by cash on delivery, an additional fee of 2, - EUR is due, which raises the deliverer on site.

 

§ 5 Delivery conditions and self-supply reservation
§ 5.1 The delivery is made according to the shipping method of your choice with the respective shipping company.

§ 5.2 The delivery time is, unless otherwise stated in the offer, about 3-5 days.

§ 5.3 If not all products ordered are in stock, we are entitled to partial deliveries at our expense, as far as this is reasonable for you.

§ 5.4 Should the delivery of the goods fail despite three attempts to deliver, we can withdraw from the contract. Any payments made will be reimbursed immediately.

§ 5.5 If the ordered product is not available because we are not supplied with this product by our suppliers without own fault, we can withdraw from the contract. In this case, we will inform you immediately and, if necessary, propose the delivery of a comparable product. If no comparable product is available or if you do not wish to receive a comparable product, we will immediately reimburse you for any consideration already paid.

 

§ 6 Terms of payment
§ 6.1 Payment is made by payment method of choice.

§ 6.2 If you select the payment method in advance we will give you our bank details in the order confirmation. The invoice amount has to be transferred to our account within 5 days. If you pay by credit card or direct debit, your account will be charged with shipping the goods. For payment by Sofortüberweisung and payment via PayPal, the payment takes place with sending the order.

§ 6.3 If you are in default of payment, the purchase price shall be charged during the default in the amount of 5% above the base rate. We reserve the right to prove and assert a higher damage caused by default.

§ 6.4 When paying by direct debit, you may have to bear any costs incurred as a result of a reversal of a payment transaction due to insufficient funds or because of incorrectly transmitted bank details.

 

§ 7 Retention of title
The goods remain our property until full payment. Before the transfer of ownership, a pledge, transfer, processing or transformation is not permitted without our consent.

 

§ 8 Right of withdrawall
§ 8.1 Consumers the right to withdraw from this contract within 14 days without giving any reason.

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.




§ 8.2 The right of withdrawal does not apply to delivery of goods,

• which are not prefabricated and whose manufacture is based on an individual choice or determination by the consumer, or which are clearly tailored to the personal needs of the consumer, for the delivery of goods that may spoil quickly or whose expiration date would quickly be exceeded,

• are not suitable for return for reasons of health or hygiene, if their seal has been removed after delivery,

• if, due to their nature, they were inseparably mixed with other goods after delivery

• not including the delivery of sound or video recordings or computer software in a sealed package, if the seal has been removed after delivery,

• for the supply of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can be delivered 30 days after the conclusion of the contract at the earliest and whose current value depends on fluctuations in the market, over which the entrepreneur has no influence.


§ 9 Transport damage
§ 9.1 If goods are delivered with obvious damage in transit, please complain such errors immediately to the deliverer, and please contact us as soon as possible (telephone 023249105818).

§ 9.2 The omission of a complaint or contact has no consequences for your statutory warranty rights. However, they help us assert our own claims against the carrier or transport insurance.

 

§ 10 warranty
For the products offered in our shop, the legal warranty rights exist.

 

§ 11 Final provision
Should a provision of these General Terms and Conditions be ineffective, the contract remains otherwise valid. In place of the invalid provision, the relevant statutory provisions apply.
